1. OpenAI Reaches $1.6B Despite Leadership Challenges 💵

OpenAI, known for ChatGPT, has seen its annualized revenue soar to $1.6 billion, a significant increase from $1.3 billion in mid-October. This growth, achieved amidst a leadership crisis, demonstrates the company's robust business momentum in selling AI to enterprises. The 20% revenue growth over two months indicates OpenAI's resilience and ability to maintain customer interest despite internal challenges.

2. US Chief Justice Roberts on AI in the Courts 🏛️

Chief Justice John Roberts addresses the potential and challenges of artificial intelligence in the U.S. federal courts. In his annual report, he acknowledges AI's role in improving access to justice for those with limited resources. However, Roberts emphasizes caution, especially after recent incidents of AI-generated fake legal citations in court records. He predicts that while AI will significantly impact judicial work, especially at the trial level, human judges will remain essential.

3. Michael Cohen's AI Legal Blunder ⚖️

Michael Cohen, former lawyer to Donald Trump, mistakenly used fake legal cases generated by Google Bard's AI in a court motion. Seeking early release, Cohen believed Bard was a supercharged search engine, not realizing its generative AI nature. This error led to the inclusion of invalid citations in his motion, prompting the judge to consider sanctions.

4. OpenAI's Strategic Shift in EU Data Compliance 🇪🇺

OpenAI, facing scrutiny over ChatGPT's privacy impact in Europe, has updated its terms to designate its Dublin-based entity as the data controller for European users. This move, effective February 15, 2024, aligns with the EU's General Data Protection Regulation (GDPR) and aims to streamline privacy oversight under Ireland's Data Protection Commission (DPC). The change follows investigations by Italian and Polish watchdogs into ChatGPT's data processing.

5. AI's Copyright Battle: A Defining Moment 📚

The AI industry faces a pivotal year as copyright lawsuits, like The New York Times' case against OpenAI and Microsoft, could shape the future of AI innovation. These legal battles, focusing on the use of copyrighted material in AI development and the status of AI-generated works, are crucial for the technology's trajectory. Experts predict that 2024 will bring significant rulings, potentially steering AI development based on legal interpretations rather than societal benefits.

We don’t blame ya.

But, the world of Generative AI didn’t sleep.

  • Hundreds of millions were raised.

  • Lawsuits were filed.

  • Unique GenAI platforms were launched.

So today, we switched the format a bit to get you caught up, highlighting some late 2023 GenAI trends and what you should be keeping an eye out for in 2024.

TBH, this is a perfect place to get started on leveraging GenAI platforms to grow your company and your career.

Let’s break down the highlights and trends for what you need to know.

1 – GenAI in the courtroom 🧑‍⚖️

One of the most consequential developments in the business world for 2024 will actually be playing out in the courts. In the waning moments of 2023, The New York Times filed a lawsuit against OpenAI and Microsoft, alleging that the paid trained ChatGPT and the GPT4 technology on its copyrighted works. 

The New York Times made a compelling case, sharing side-by-side comparisons of its reporting and responses generated within ChatGPT, which showed nearly verbatim text without attribution or links back to the New York Times. 

This X/Twitter thread breaks it down nicely. 

What it means:
There’s hundreds of current copyright cases in the courts against different GenAI platforms and Large Language Models. How will this impact the biz world?

We expect to see a slight pause on development and new features, which may greatly impact real world implementation. The outcome of this case will be monumental for the Generative AI industry in general, as well as the likelihood of Big Business fully adapting to LLMs as part of their daily workflows. 

2 – OpenAI growing despite turmoil 📈

Yeah, there was a bit of drama at Open AI in the last quarter of 2023. Between OpenAI firing (and swiftly rehiring) CEO Sam Altman to the introduction of its new GPT4-Turbo model and Custom GPTs, OpenAI made a lot of splashes late in the year. 

What it means:
With the drama (probably) behind it, OpenAI reportedly is now running at an annualized revenue rate of $1.6 billion.

Sheeeeesh.

Expect OpenAI’s custom GPT store to open in the very near future, as recent reports have said the launch will be early 2024. Expect GPTs to really dominate the conversation once the GPT Store officially launches. If your biz isn’t already leveraging your public data with a custom GPT, you’re at risk of falling behind. 

3 – Anthropic $850M in 2024 revenue 💰

The underdog is making some giant moves. 

Anthropic, which released its Claude 2.1 LLM update in the fourth quarter, is reportedly projected 2024 revenue to be at $850 million. 

What it means:
Depending on what happens with the New York Times vs. OpenAI/Microsoft case, expect to see Anthropic make a hard play to pick up more enterprise customers, as they did in the midst of the Sam Altman drama.

TBH, we’re not super high on Claude yet, but we expect to see some big announcements from Anthropic in the first few months of 2024. 

4 – Mixed reviews for Google’s Gemini 😬

Yeah, we kinda already roasted Google and its Gemini rollout. 

In addition to its somewhat deceptive video announcement, Google’s newest model powering its Bard service is reportedly underperforming. 

What it means:
Don’t write off Google Bard and the new Gemini model just yet. Just like Anthropic may be moving in on the enterprise space amidst the New York Times vs. OpenAI case, expect Google to do the same.

While Gemini’s ‘Pro’ version is more in the category of GPT3.5 or GPT4, its forthcoming ‘Ultra’ model is expected to perform much better. If your company is on Google Workplace, it’s worth trying out Google’s built-in AI features. 

5 – AI could impact 30K at Google 👥

Sorry to be the bearer of bad 2023/2024 news, but AI is gonna cause a lot of job displacement. That was even the topic of our very first episode of Everyday AI. 

Recent reports have suggested that Google may be laying off a chunk of its 30,000 staff who work in the ads department, as their AI implementation in that department has been better than expected. 

What it means:
Layoffs due to AI implementation are going to be grabbing a lot of headlines. We’re not sure if this Google layoff will be the first big domino to fall in 2024 when it comes to AI job displacement, but it’s worth keeping an eye on. 

6 – Microsoft Copilot app on mobile 📱

Been on the fence about going all in on GPT4 because of the $20/month subscription for ChatGPT Plus? 

Well, Microsoft’s newest app releases can help fill that void. The company in the past week rolled out its Copilot apps for Android and iOS, bringing free GPT4 access to the masses.

What it means:
Like we talked about in today’s show, GenAI usage is essential to grow your company and career.

We recommend replacing traditional search with leveraging a GenAI tool. Whether that’s ChatGPT with Plugins, Google Bard, or these new Copilot apps from Microsoft, your choices are growing.  

7 – Apple working on its AI offering 🍏

Guess who’s been noticeably silent on the Generative AI front? 

Apple. 

Like we talked about months ago, you shouldn’t count Apple out. Recent reports are showing that Apple is spending upwards of $50 million for content partnerships for its AJAX/GPT style offering it is working on. 

What it means:
Apple is usually fashionable late to the party. Like we talked about, if Apple releases a LLM that works natively on its iPhone and Mac lineup, it should be an instant home run.

8 – Pika Labs launches 1.0 🎥

Watch out — Pika 1.0 is here. 

We talked bout Pika’s impact when making bold predictions for 2024, and gave you a quick breakdown of the platform in today’s AI in 5.

With a recent $55 million funding round, expect to see Pika pick up market share in the text-to-video space. 

What it means — Improved (and usable!) text-to-video and photo-to-video is going to dominate 2024 headlines the same way traditional LLMs dominate in 2023. We recently broke down what the future of AI video means. 

9 – TTI update in Midjourney’s v6 🖼

Midjourney just got a HUGE upgrade

With its most recent updates, Midjourney is widening its lead in the text-to-photo space. 

What it means — With improved quality, built-in upscaling and better prompt control, expect to see even more AI-generated images being used in everyday use-cases.
